Frequently asked questions

How does the firm work with a tax adviser?

The firm works with a tax adviser. The scope of each professional's involvement is agreed individually, depending on the matter. Whatever the number of specialists involved in your case, you have a single, consistent point of contact at the firm.

Does an individual tax ruling protect the taxpayer?

Complying with an individual tax ruling issued in your matter provides protection to the extent set out in the Tax Ordinance (Ordynacja podatkowa) - among other things, it excludes fiscal criminal liability and, within certain limits, the obligation to pay the tax. However, the protection covers only the facts described in the application, so precisely formulating the query is of key importance.

I have received notice of the intention to open a tax audit. What should I do?

Please contact us before the audit begins. It is worth organizing your documentation, establishing the scope of the audit stated in the authorization, and preparing the people who will be providing explanations. The party being audited has certain rights, including the right to raise objections to the record. Preparing in advance reduces the risk of misunderstandings at later stages of the matter.

Does an irregularity in a tax return always result in a fiscal criminal matter?

No. What matters is the nature of the failure, its scale, and the steps taken after it was discovered. Correcting the return together with settling the public-law liability, and, in appropriate cases, a voluntary disclosure (notifying the authorities that a prohibited act has been committed), may affect the course of the matter. We assess every situation individually, combining the tax and fiscal criminal perspectives.
