Frequently asked questions

How long does a divorce case take?

The length of proceedings depends above all on whether the spouses agree on the divorce and its terms, and on whether the court is to make a finding of fault. Cases without a finding of fault and without a dispute concerning children usually conclude more quickly. Hearing dates are set by the court, so it is not possible to indicate a precise timeframe in advance. We discuss the likely course of proceedings in your situation at the first consultation.

What is the difference between a divorce with a finding of fault and one without?

A divorce without a finding of fault requires both spouses to make a joint request and simplifies the taking of evidence. A finding of fault requires proving the fault of a particular spouse, which lengthens the case, but it may be relevant to the maintenance obligation between former spouses. We discuss the choice of route individually, taking into account your family and financial situation.

Can a matter be concluded by agreement, without a trial?

In many family matters, this is possible. An agreement on parental authority and contact, a maintenance settlement, or a property division agreement can limit the dispute and shorten proceedings. A settlement reached before a mediator and approved by the court has the legal effect of a settlement concluded before a court and, once it has been endorsed with an enforcement clause, can - like a court settlement - serve as a basis for enforcement. We always present you with both routes - amicable and court - together with their consequences.

What documents should I prepare for the first meeting?

It is helpful to bring an abbreviated copy of the marriage certificate, copies of the children's birth certificates, and documents concerning your financial situation - information about real property, loans and income. If any proceedings have already taken place in the matter, please bring any court documents you have received. Missing some of the documents does not prevent you from arranging a consultation.

How much does the first consultation cost?

The initial consultation (up to 60 minutes) costs PLN 300 net. During the meeting, the advocate reviews your situation, answers your questions and sets out the possible next steps and the terms of any further cooperation. More about the first meeting
