Frequently asked questions

I have received a summons to be interviewed as a witness. Should I contact an advocate?

It is worth considering contacting an advocate before the procedural act takes place. A witness's status may change in the course of proceedings, and even at the interview stage you have certain rights - including the right to refuse to answer a question if answering it could expose you or a person close to you to criminal liability.

Can an advocate be present at a detention and the first interview?

A detained person has the right to contact an advocate and to speak with them. Defense counsel may take part in procedural acts involving the suspect, including the first interview. In urgent matters, please contact us by phone - the ability to take certain steps, such as lodging an interlocutory appeal against the detention, is limited by short deadlines.

What is the difference between criminal proceedings and fiscal criminal proceedings?

Fiscal criminal proceedings concern acts described in the Fiscal Penal Code (Kodeks karny skarbowy) - relating to taxes, customs duties, foreign exchange transactions and gambling. They are governed by separate rules: financial authorities play a significant role, and the mechanism of voluntary submission to liability, as well as the effect of settling the public-law liability on the course of the case, work differently than in ordinary criminal proceedings.

I am a victim of crime. Can I take part in the criminal trial?

A victim may act in court proceedings as an auxiliary prosecutor, which allows them to file evidentiary motions, ask questions and lodge appeals. Within the criminal proceedings, it is also possible to claim damages and compensation for harm. We represent victims both at the pre-trial stage and before the court.
