Frequently asked questions

Before bringing a matter to court, is it necessary to demand payment from the other party?

In civil matters, the statement of claim should state whether the parties attempted to resolve the dispute amicably. A demand for payment clarifies the situation, sets a deadline and is often enough to conclude the matter without a trial. We prepare such demands and conduct further negotiations, and where these do not bring results, we bring the matter to court.

After what period does a claim become time-barred?

The general rule is a six-year limitation period, and a three-year period for claims connected with business activity and claims for periodic performance. There are, however, a number of exceptions to these rules. Calculating the period depends on the type of claim and when it fell due, so we ask you to bring the relevant documents to the consultation.

What does the protection of personal rights involve?

Personal rights include, among other things, honor, good name, image, privacy and the confidentiality of correspondence. A person whose right has been infringed may demand that the infringement cease, that its effects be removed - for example, through the publication of a statement - and payment of compensation or a sum for a specified social purpose. This protection also extends, with the necessary modifications, to legal persons, in respect of their reputation.

What is acquisitive prescription of real property?

Acquisitive prescription allows ownership of real property to be acquired through long-term possession as owner - after twenty years if in good faith, and after thirty years if in bad faith. The case is heard by the court in non-contentious proceedings and requires demonstrating the nature of the possession and its uninterrupted duration. We help gather the documentation and conduct such proceedings.
