Frequently asked questions

Does a work need to be registered somewhere to be protected?

No. Copyright protection arises from the moment the work is fixed, without registration and without completing any formalities. Registration is, however, necessary for industrial property rights - trademarks, industrial designs and patents. In practice, it is worth keeping evidence of authorship and the date the work was created, and ensuring proper agreements with creators and subcontractors.

What is the difference between a trademark and an industrial design?

A trademark protects a sign that distinguishes the goods or services of one business from those of other businesses - most often a name or a logo. An industrial design protects the appearance of a product: its shape, lines, coloring or ornamentation. The scope and duration of protection, and the registration procedures, differ, so we discuss the choice of the appropriate instrument at the consultation.

What should we do if someone is using our mark or work without permission?

Usually the first step is to preserve evidence of the infringement and send a cease-and-desist demand. The rights holder may claim that the infringement cease, that its effects be removed, damages, and the surrender of the benefits obtained. Intellectual property matters are heard by specialized courts. We advise on the choice of approach and conduct the case.

When is a patent attorney needed?

Patent attorneys are professionals who specialize in industrial property matters. Alongside legal knowledge, they also have extensive technical expertise, which is essential for applications for the grant of a patent for an invention. In matters concerning obtaining patent protection, only a patent attorney may act as a representative.
